Please read these Terms and Conditions carefully. They govern your use of the RestorationsPro LLC website and the communications described below. A separate written service agreement may apply to work performed at a property. If a signed service agreement conflicts with these website terms, the signed service agreement controls for that project.

1. Acceptance of these terms

By accessing or using this website, you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use the website.

You must use this website only for lawful purposes. If you use the website on behalf of a business or other organization, you represent that you have authority to accept these terms for that organization.

2. Our services

RestorationsPro LLC provides restoration-related services, including water-damage mitigation, fire and smoke restoration, mold remediation, contents services, and related property-restoration work. Website descriptions are general information only. They are not a guarantee that a particular service is available, appropriate, or sufficient for every property or condition.

The scope of work, price, schedule, payment terms, warranties, insurance-related responsibilities, and other project details are established only in the written documents signed for that project. RestorationsPro does not promise that an insurer will approve coverage or pay any particular amount.

3. Estimates and quotes

An estimate, quote, proposal, inspection summary, or other preliminary communication is not binding until it is included in a written agreement signed by RestorationsPro and the customer. Unless a signed agreement says otherwise, pricing and timing may change if the requested scope changes or if hidden, unsafe, inaccessible, or previously unknown conditions are discovered.

Website content, telephone discussions, text messages, and emails do not modify a signed project agreement unless the change is confirmed in writing by an authorized RestorationsPro representative.

4. SMS and text messaging terms

When you provide RestorationsPro with a mobile telephone number and affirmatively agree to receive text messages, you consent to receive recurring text messages from RestorationsPro LLC at that number. Consent to text messaging is not a condition of purchasing goods or services.

Delivery. Wireless carriers are not liable for delayed or undelivered messages. Text delivery is subject to network availability and carrier services and is not guaranteed.

If your number changes or is reassigned, please notify RestorationsPro promptly. RestorationsPro may change, suspend, or discontinue its text messaging program at any time.

You may not misuse the website, interfere with its operation or security, attempt unauthorized access, introduce malicious code, scrape or copy content through automated means, impersonate another person, or use the website in violation of law or another person’s rights.

This includes loss of data, revenue, business opportunity, or goodwill, even if RestorationsPro was advised that such damages were possible.

To the fullest extent permitted by law, RestorationsPro’s total liability for claims arising solely from use of the website will not exceed the amount, if any, that you paid to use the website. Liability related to contracted restoration services is governed by the signed project agreement and applicable law.

You agree to defend, indemnify, and hold harmless RestorationsPro LLC and its owners, employees, contractors, and agents from claims, losses, liabilities, and reasonable costs arising from your unlawful misuse of the website, your violation of these terms, or your infringement of another person’s rights. This obligation applies only to the extent permitted by law.

10. Governing law and disputes

These terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any legal action arising from these website terms must be brought in a state or federal court with jurisdiction over Monroe County, Tennessee, and you consent to that court’s jurisdiction and venue.

If any provision of these terms is found unenforceable, the remaining provisions will continue in effect. A failure by RestorationsPro to enforce a provision is not a waiver of that provision. These terms, together with the Privacy Policy and any applicable signed project agreement, contain the applicable agreement concerning their respective subjects.

11. Changes to these terms

RestorationsPro may update these terms from time to time. The revised version will be posted on this page with a new effective date. Changes apply prospectively when posted unless a different date is stated. Your continued use of the website after an update means you accept the revised terms.
